California Bail Truth
To clarify this mess:
Under SB 1026 (the "Bail Fugitive Recovery Agent Reform Act"), California is officially making the impossible mandatory.
• The Trap: The state requires liability insurance for "willful acts" (which is legally uninsurable under Section 533).
• The New Twist: SB 1026 now requires that insurance to come from an admitted carrier.
• The Reality: X Insurance the only company actually willing to cover this high-risk work is a non-admitted (surplus lines) carrier.
So, California is mandating you buy a "Get Out of Jail Free" card, but they just banned the only shop that sells them. By requiring an "admitted" carrier to cover uninsurable acts, the state is essentially legislating the entire profession into extinction.
If you can't find a carrier that doesn't exist to cover a risk that's illegal to insure, do you even exist?
